RE: The tariff classification of Moxifloxacin Hydrochloride (CAS-186826-86-8) in bulk form, from Italy

Dear Ms. Forstenzer:

In your letter dated October 11, 2010, you requested a tariff classification ruling.

The subject product, Moxifloxacin Hydrochloride, is a fourth generation synthetic fluoroquinolone antibacterial agent. It is indicated for the treatment of various bacteria infections including acute bacterial sinusitis, acute exacerbations of chronic bronchitis, and community-acquired pneumonia. It is also indicated for the treatment of skin and skin structure infections and intra-abdominal infections.

The applicable subheading for the Moxifloxacin Hydrochloride will be 2933.49.2600, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Heterocyclic compounds with nitrogen hetero-atom(s) Only: Compounds containing in the structure a quinoline or isoquinoline ring-system (whether or not hydrogenated), not further fused: Other: Other: Drugs: Other.” Pursuant to General Note 13, HTSUS, the rate of duty will be free.
